1. TERMS

1.1 In these Terms and Conditions “we” and “us” refer to THE SOUTHERN AFRICA HIGHER CHRISTIAN EDUCATION TRUST, hereafter SAHCET.

1.2 In these Terms and Conditions “you” refer to the user of this website, whether a browser, associate, student, account holder or buyer.

2. USAGE

2.1 Persons using the SAHCET web site for any reason whatsoever subject themselves to and agree to the terms and conditions of SAHCET when accessing the web site as set out below.

2.2 This web site is intended to provide the user with information regarding SAHCET, and/or its services rendered.

2.3 Without derogating from the aforegoing, SAHCET hereby authorises the user to view, copy, download to a local drive and print the content of this web site, or any part thereof, provided that:

2.3.1 Such content is used for information and/or non-commercial purposes only; and

2.3.2 Any reproduction of this the content of this web site, or portion thereof, must include the following copyright notice:

2.5 Only registered users may order study material from us.

2.6 To register access the “My Account” page or register when you go to “Checkout”.

2.7 Keep your username and password confidential. If the correct username and password have been given, orders are regarded as coming from you and you will be liable for payment.

2.8 By using this website you confirm that you are 18 (eighteen) years old and have full legal capacity.

3.8 Main business: SAHCET is a trust to promote, develop and facilitate Christ-centred higher education of people. We assist student teachers and schools associated with SAHCET with the administration of higher education studies through higher education institutions nationally and internationally and negotiate on behalf of said associates and student teachers with SAQA and SACE. We further coordinate mentoring for student teachers through associate schools.

3.9 We have a Returns Policy (see paragraph 10).

3.10 A full record of each transaction is available on the User’s Account page.

4. PRIVACY POLICY

4.1 SAHCET values your right to privacy and strive to effectively protect your personal information.

4.2 We will only gather personal information that is necessary to close a transaction:

4.2.1 Name;

4.2.2 Contact details (telephone number, delivery address, billing address and email).

4.3 If your account remains inactive for a period exceeding one year, we shall cancel your account and delete all your personal information after having given you the opportunity to object to such cancellation. Should you however want to delete your personal information at an earlier stage, you will have to unsubscribe, thereafter we shall delete your personal information subject to our returns policy.

4.4 You may access your account information at any time to change it and opt in or out of any marketing communication.

4.5 Should you have any queries, concerns or complaints about the way we handle your personal information, please contact us at info@sahcet.org. You also have the right to contact the Information Regulator at inforeg@justice.gov.za, if you suspect that we are misusing your data.

4.6 You may at any time request access to the personal information that we have of you. 

4.7 No personal information will be disclosed to third parties without the user’s permission or due process.

4.8 SAHCET gathers and will be in possession of the following private and personal information:

4.8.1 Information you provide voluntarily – this information is used to provide a better service to users or to close transactions; and

4.8.2 Information automatically provided (e.g. cookies) – this information is gathered to better your browsing and interaction with SAHCET. See the Cookie Policy in paragraph 5 for more information.

4.9 By using this web site you consent to the following:

4.9.1 We may use your personal information to communicate with you from time to time if you opt in to receive such information. You may opt out at any time.

4.9.2 We may use your information for non-personal statistical purposes.

4.9.3 We retain the copyright in databases of personal information of users.

9. SECURITY SAFEGUARDS

9.1 All reasonable steps will be taken to secure your information.

9.2 You undertake not to divulge your user name and passwords to any other person.

9.3 It is expressly prohibited for any person, business, or entity to gain or attempt to gain unauthorised access to any page on this web site, or to deliver or attempt to deliver any unauthorised, damaging or malicious code to this web site. 10. DONATIONS

10.1 These Terms and Conditions apply separately to each single donation that you make. Except as provided for in section 10.6, “Regular Donations”, and unless specified by you, they do not form a contract allowing for future or successive transactions to be set up. By confirming on the Website that you wish to make a donation you agree to be bound by these Terms and Conditions for that donation.

10.2 We will use your donation at our discretion but within our stated charitable objectives.

10.3 All payments through the Website (https://sahcet.org) are to be made by card. We also accept direct bank payment. See paragraph 12 for more information.

10.4 Before we can process a donation you must provide us with your name, address and email address. We will use this information to process your donation. It is your responsibility to ensure you have provided us with the correct information. See paragraph 4 for our Privacy Policy. By agreeing to these Terms of Use you are also agreeing to the way we use and protect your personal information in line with our Privacy Policy.

10.5 When you set up a regular donation you will be scheduling a series of donations to be made on the day of the month that you choose until further notice. You agree that these Terms and Conditions will apply to each of the donations in that series.

10.6 By confirming that you wish to proceed with a regular donation you authorise our payment service provider, PayFast, to request funds from your credit or debit card on the day of each month that you set.

10.7 To cancel your regular donation, please contact us at info@sahcet.org.

11. REFUND

11.1 If you make an error in your donation, please contact us either by email at info@sahcet.org or phone at +27 72 140 5880 within 14 days and a full refund will be made to you.

12. PAYMENT

12.1 There are two options for payment:

12.1.1 Electronic funds transfer or direct bank payment; or

12.1.2 Payment through Payfast, South Africa’s secure online payment gateway. Find their privacy policy here. PayFast is a PCI DSS Level 1 Service Provider (the highest level). You can read about their security here.

12.2 We will never request your bank details – not through our website or by email.

12.3 If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.

13. COPYRIGHT AND INTELLECTUAL PROPERTY

13.1 All content, trademarks and data on this web site, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, training material and designs are the property of or licensed to © SAHCET, and as such, are protected from infringement by domestic and international legislation and treaties. Subject to the rights afforded to the user herein, all other rights to all intellectual property on this site is expressly reserved.

14. DISCLAIMER

14.1We shall not be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this web site or the services or content provided from and through this web site. Furthermore, we do not make any representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this web site are free from errors or omissions or that the service will be 100% uninterrupted and error free.

15. SEVERABILITY

15.1 These Terms and Conditions of Use constitute the entire agreement between SAHCET and you, the user of this web site. Any failure by SAHCET to exercise or enforce any right or provision of these Terms and Conditions of Use shall in no way constitute a waiver of such right or provision.

15.2 In the event that any term or condition of the use of this web site is not fully enforceable or valid for any reason, such term(s) or condition(s) shall be severable from the remaining terms and conditions. The remaining terms and conditions shall not be affected by such unenforceability or invalidity and shall remain enforceable and applicable.

16. APPLICABLE AND GOVERNING LAW

This web site is hosted, controlled and operated from the Republic of South Africa, and thus the South African Law governs the use or inability to use this web site and these terms and conditions.

17. ARBITRATION

17.1 Any disputes or differences between SAHCET and you arising out of your use of our web site will be submitted to conciliation and arbitration as provided by the UNITRAL Conciliation and Arbitration Rules in respect of which the Arbitration Foundation of Southern Africa will act as the appointing authority.

17.2 Any arbitration will take place in Pretoria, South Africa, with English as medium.
